General Terms and Conditions

1. Scope

The following Terms and Conditions apply to all orders placed through our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

With regard to entrepreneurs, the following applies: if the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contract Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with Müller und Sarikaya, FeGo Arts GbR.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: German

We store the contract text and send you the order data and our Terms and Conditions in text form. You can view the contract text in our customer login area.

4. Delivery Conditions

We deliver free of shipping costs.

We only deliver by shipping. Unfortunately, collection of the goods in person is not possible.

We do not deliver to parcel stations.

5. Payment

The following payment methods are generally available in our shop:

Advance Payment (2% discount)
If you choose advance payment, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.

Credit Card
During the ordering process, you enter your credit card details. Your card will be charged immediately after the order is placed.

PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information is provided during the ordering process.

Pay with Klarna
If this payment method is selected, payment processing is carried out via Klarna. Further information on the available Klarna payment options and the respective terms and conditions is provided during the ordering process. Where required, successful address and credit checks by Klarna are a prerequisite for using this payment method. Further information is provided during the ordering process.

EPS
If you select the EPS payment method, payment is made via your online banking account with a participating bank. Your account will be charged immediately after confirming the payment instruction. Further information is provided during the ordering process.

iDEAL
If you select the iDEAL payment method, payment is made via the online banking service of your participating bank. Your account will be charged immediately after confirming the payment instruction. Further information is provided during the ordering process.

Bancontact
If you select the Bancontact payment method, payment is made via the Bancontact payment service. Your account will be charged immediately after confirming the payment instruction. Further information is provided during the ordering process.

Google Pay
In order to pay the invoice amount via Google Pay, you must be registered with Google, have activated the Google Pay function and confirm the payment using your access data. The payment transaction is carried out immediately after the order is placed. Further information is provided during the ordering process.

Apple Pay
In order to pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. Further information is provided during the ordering process.

6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Businesses are not granted any voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment has been made.
For entrepreneurs, the following additionally applies: we retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale in the amount of the invoice amount, irrespective of any combination or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorised to collect the claims; however, we may also collect the claims ourselves if you fail to meet your payment obligations. We will release the securities to which we are entitled at your request insofar as the realisable value of the securities exceeds the value of the outstanding claims by more than 10%.

8. Transport Damage

For consumers, the following applies: if goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

For entrepreneurs, the following applies: the risk of accidental loss and accidental deterioration passes to you as soon as we have handed over the item to the forwarding agent, carrier or other person or institution designated to carry out the shipment.

9. Warranty and Guarantees

9.1 Liability for Defects

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.

The following limitations and shortening of periods shall not apply to claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health
  • in the event of intentional or grossly negligent breach of duty and fraudulent intent
  • in the event of breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the scope of a guarantee promise, where agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

Limitations vis-à-vis entrepreneurs

With regard to entrepreneurs, only our own statements and the manufacturer's product descriptions that have been included in the contract shall be deemed agreed as the quality of the goods; we assume no liability for public statements made by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk.

The statutory limitation periods for the right of recourse pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.

Regulations for merchants

Among merchants, the obligation to inspect and give notice of defects regulated in Section 377 of the German Commercial Code (HGB) applies. If you fail to give the notice regulated therein, the goods shall be deemed approved, unless the defect was not recognisable during the inspection. This shall not apply if we have fraudulently concealed a defect.

9.2 Guarantees and Customer Service

Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

10. Liability

We shall always be liable without limitation for claims arising from damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the event of guarantee promises, where agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), through slight negligence by us, our legal representatives or vicarious agents, liability shall be limited in amount to the foreseeable damage typical for the contract at the time of conclusion of the contract.
Otherwise, claims for damages are excluded.

11. Dispute Resolution

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

If you are an entrepreneur, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
